STR Loophole Sidebar: Spousal REPS Play

Here is a version of this strategy that does not need the 7-day rule at all. If you file a joint tax return and one spouse can qualify as a Real Estate Professional, your long-term rental losses can offset the other spouse’s W-2 income. No short average stay required. No Airbnb turnover at 11am. No listing updates at 2am because you are freaking out about a big hole in your bookings.

The setup is refreshingly domestic. One spouse earns the big W-2. The other manages the rental portfolio and, if the hours are real, becomes the household’s Real Estate Professional under IRC Section 469(c)(7). “Hey babe, you go out and make that big W-2, I’ll manage the rentals to create additional wealth and tax deductions.” It is teamwork with a tax return attached.

The catch is that REPS is measured per spouse, not combined. The real estate spouse must clear 750 hours and spend more than half of their total personal service time in real property trades or businesses. That second test is the hard one. A spouse leaving a full-time job to run the rentals fits this beautifully because there are no competing work hours in the denominator. A spouse still working 30 hours elsewhere, less so.

Meeting one of the material participation tests on the rentals still matters, but that is a separate and far friendlier bar to clear.

Fair warning though. No, this isn’t teamwork makes the dream work. Barf. This is hard work. REPS wants 750 real hours in real property trades or businesses, so it usually takes more than a rental or two and often a real estate license or a design or construction business to get there.
