The Situation

He is a full-time W-2 financial advisor renting in New York City who purchased a $1.4 million short-term rental property in upstate New York. He had lined up a cost segregation study, understood the short-term rental tax loophole, and was planning to material participate to meet the 100-hour threshold. He wanted one thing: confirmation that his plan was solid and expert help making sure the execution held up under scrutiny.

The Strategy

The core play is the STR loophole paired with bonus depreciation from a cost segregation study. With an average guest stay of seven days or fewer and material participation, rental losses are treated as nonpassive and can offset his W-2 income directly. Real estate professional status is off the table given his full-time W-2 job, so the STR loophole is the right vehicle.

The WCG team confirmed his approach and sharpened a few edges. The most important: material participation hours do not begin accumulating until the property is placed in service and accepting guests. Time spent on renovations before that date counts as investor hours, which are wasted from a material participation standpoint. Getting the property live and hosting at least a few rentals before year-end starts the clock and protects the strategy. They also pointed him to Reps Log to document hours in real time rather than trying to reconstruct a time log in January.

On the cost segregation side, WCG will reconcile the engineering report against his settlement statement. The two never match exactly (or it is rare unless you use Maven Cost Seg), and that reconciliation work ensures every dollar he has in the property gets depreciated at the right rate across the right asset classes. That first-year depreciation schedule is the foundation everything else is built on.

The Outcome

Jason K. left the meeting with his tax strategy intact and a cleaner execution plan. The in-service date timing, time tracking discipline, and depreciation setup are the three variables that will determine whether the short-term rental tax strategy delivers as expected. For a high W-2 earner with no other complex offsetting deductions, getting this right in year one means the losses flow directly against ordinary income rather than sitting on the shelf as suspended passive losses.
